Spouse / Fiancé of Green Card Holder
K- visas allow certain foreign spouses and fiancé(e)s of U.S. citizens—as well as their eligible children—to come to the United States temporarily while completing the immigration process. These visas help families reunite sooner, whether to marry in the United States or to wait together while an immigrant visa petition is pending. After entering the U.S., eligible K- visa holders may apply to adjust status to become lawful permanent residents.
K-1 & K-2 Visas – Fiancé(e) of a U.S. Citizen
The K-1 visa is for the foreign-citizen fiancé(e) of a U.S. citizen. It allows the fiancé(e) to travel to the United States for the purpose of marrying their U.S. citizen sponsor within 90 days of arrival. After the marriage takes place, the foreign spouse may seek adjustment of status to obtain a green card.
The K-2 visa is available to the unmarried children (under age 21) of a K-1 beneficiary. K-2 children may accompany or follow the parent to the United States and later apply for permanent residence.
K-3 & K-4 Visa – Foreign National Spouse
The K-3 visa is designed for the foreign-citizen spouse of a U.S. citizen. It allows the spouse to enter the United States while the underlying immigrant visa petition (Petition for Alien Relative- Form I-130) is pending. Once in the U.S., a K-3 visa holder may remain while waiting for the immigrant petition to be approved and may then apply for adjustment of status.
The K-4 visa is available to the unmarried children (under age 21) of a K-3 beneficiary. K-4 children may travel with or join their parent in the United States and later pursue permanent residence once the underlying family-based petition is approved.
