Appeals, Motions, RFE, NOIR, and NOID

Appeals

An appeal is a formal request to a higher authority, such as the Administrative Appeals Office (AAO) or the Board of Immigration Appeals (BIA), to review and reverse a decision issued by U.S. Citizenship and Immigration Services (USCIS). Appeals must be filed within strict timeframes and must clearly identify errors in fact or law. Not all decisions are appealable, and only certain parties (typically the petitioner) may file.

Motions to Reopen or Reconsider

A motion to reopen asks the original USCIS office to review a decision based on new facts or evidence not previously submitted. A motion to reconsider argues that the original decision was legally or factually incorrect based on the existing record. Both motions must be filed within 30 days and must include detailed legal and factual arguments.

Request for Evidence (RFE)

An RFE is issued when USCIS requires additional evidence to make a decision on a pending case. This may involve missing documentation, expired evidence, or a need for clarification. RFEs give petitioners or applicants an opportunity to submit the necessary information to demonstrate eligibility and keep the case moving forward.

Notice of Intent to Revoke (NOIR)

A NOIR is issued after a petition has already been approved. It notifies the petitioner that USCIS is considering revoking the approval, typically due to new evidence, eligibility concerns, or other derogatory findings. A timely and well-supported response is essential to prevent revocation and protect the beneficiary’s immigration status.

Notice of Intent to Deny (NOID)

A NOID signals that USCIS intends to deny a petition or application unless the applicant resolves significant concerns. It is more serious than an RFE and often requires detailed legal rebuttal and supporting documentation. Failure to respond will usually result in a denial.
